General Terms of Sale — gianpiocappucci.it

These terms govern purchases made on this website.

1. Seller
The products are sold by M.H.P. S.R.L., Piazza Giacomo Matteotti 4, 80053 Castellammare di Stabia (NA), Italy, tax code and VAT no. 11009711216, REA NA-1148374, share capital €10,000.00 fully paid, PEC mhp_srl@pec.it, email shop@gianpiocappucci.it (“Seller”).
The Cappucci Hairstyle & Beauty trademark is used by the Seller under licence from Gianpio Cappucci, Via Marina 1, 20121 Milan (MI), Italy, VAT no. 11452790154. The trademark owner is not a party to the sales contract.

2. Subject and customers
These terms govern the distance selling of products through the website to consumers, under the Italian Consumer Code (Legislative Decree 206/2005) and Legislative Decree 70/2003. The website is reserved for consumers: purchases by professionals are not permitted. For supplies to salons and retailers, please contact the Seller at shop@gianpiocappucci.it.

3. Products
The products are cosmetics compliant with Regulation (EC) 1223/2009. Responsible Person under art. 4 of the Regulation: Laboratorio Cosmetico Artigianale S.a.s. di Massimo Desiderio, Piazza Giacomo Matteotti 4, 80053 Castellammare di Stabia (NA), Italy, VAT no. 06022021213. The products are notified on the European CPNP portal.
Images and descriptions are as faithful as possible, but may differ slightly from the actual product, particularly in how colors are rendered on screen.
The color result of the herbal hair dye blends depends on the starting base, the percentage of gray hair, the porosity of the hair and previous treatments (chemical colors, bleaching, henna). The result shown on the product pages is therefore indicative and not guaranteed to be identical for every person. Customers must read the instructions for use, carry out the preliminary strand test and the skin sensitivity test indicated on the label, and must not use the product in case of reactions. The Seller is not liable for different results due to failure to follow the instructions.

4. Prices
All prices are in euros and include VAT. Shipping costs are shown before the order is confirmed. The price displayed at the time of the order applies. Discount codes and promotions cannot be combined unless otherwise stated.

5. Conclusion of the contract
Sending the order constitutes a purchase offer. The contract is concluded when the Seller sends the confirmation email, which summarizes products, prices and shipping costs and contains the link to these terms and to the withdrawal form. The Seller may refuse incomplete or irregular orders. If a product is not available, the customer is informed and any amount already paid is refunded within 14 days.

6. Payment
Credit and debit cards (Visa, Mastercard, American Express), PayPal, Apple Pay, Google Pay and Shop Pay are accepted. Transactions take place over a secure connection through Shopify Payments and PayPal, and the Seller does not store card details. The amount is charged when the order is confirmed. Cash on delivery is not available.

7. Shipping and delivery
Products are shipped to Italy, the countries of the European Union, Switzerland, the United Kingdom, the United States, Canada, Australia and the other countries shown at checkout, with the times and costs described on the Shipping page. Delivery times are indicative and not binding. For shipments outside the European Union, duties, import taxes and customs clearance fees are paid by the recipient and are not included in the price.
The risk of loss of or damage to the products passes to the customer upon delivery. Customers are asked to report any damaged or incomplete parcels within 7 days of delivery to shop@gianpiocappucci.it, attaching photos; failure to do so does not affect their statutory rights.

8. Right of withdrawal
Consumers may withdraw from the contract, without giving any reason, within 14 days of the day they receive the products.
The right of withdrawal can be exercised:
– using the “Withdraw from the contract here” function, available in the website footer throughout the withdrawal period; the customer immediately receives an email confirmation with the content, date and time of the request;
– or by sending an explicit statement, or the withdrawal form available on the Returns and refunds page, to shop@gianpiocappucci.it.

Exclusion: under art. 59(e) of the Italian Consumer Code, the right of withdrawal does not apply to sealed products that have been opened after delivery, for hygiene and health protection reasons. Products with an intact seal can still be returned.

Products must be returned to the Seller within 14 days of the notice of withdrawal, intact and in their original packaging, to the address given in the withdrawal confirmation. Return costs are paid by the customer.

The price and standard delivery costs are refunded within 14 days of the notice of withdrawal, using the same means of payment used for the purchase. The Seller may withhold the refund until it has received the products or proof that they have been sent. The customer is liable for any reduction in the value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning. Duties and import taxes already paid for shipments outside the European Union are not refunded by the Seller.

9. Legal guarantee of conformity
All products are covered by the legal guarantee of conformity provided for by articles 128 et seq. of the Italian Consumer Code, lasting 24 months from delivery. In the event of a lack of conformity, the customer is entitled to replacement of the product or, if this is impossible or excessively costly, to a price reduction or termination of the contract. To claim under the guarantee, write to shop@gianpiocappucci.it stating the order number and a description of the defect. A color result different from expectations, where the product is compliant and the instructions have been followed, does not constitute a lack of conformity.

10. Complaints and dispute resolution
For complaints and reports, including those about undesirable effects of the products, write to shop@gianpiocappucci.it; the Seller replies within 5 business days. For disputes, consumers may contact the alternative dispute resolution (ADR) bodies referred to in articles 141 et seq. of the Italian Consumer Code, including the conciliation services of the Chambers of Commerce.

11. Applicable law and jurisdiction
These terms are governed by Italian law. For disputes with consumers, the court of the consumer's place of residence or domicile has jurisdiction. In all other cases, the Court of Torre Annunziata has jurisdiction.

12. Changes
The Seller may update these terms. Orders are governed by the version published at the time the order is sent.
